Satisfaction Guarantee

If you are not satisfied with the performance of your iBEAM Construction Camera within 30 days of initial delivery, you may exchange the camera with full credit for a different camera model or return the camera for a full refund.

This Satisfaction Guarantee applies to iBEAM Construction Cameras acquired by you from iBEAM. Camera must be returned (prepaid freight) in its original condition (in original packaging with all instructions, housings, power supplies, etc.).

This Satisfaction Guarantee is not applicable to cameras damaged or destroyed due to reasons beyond iBEAM’s control or responsibility or damaged or destroyed by the Customer, its employees or agents.

Lifetime Warranty

iBEAM provides a Lifetime Warranty for our cameras and warrants each camera to be free from defects in materials and workmanship for the camera’s lifecycle. iBEAM will, at its option, repair or replace the defective camera at no charge, provided that the camera has not been subjected to abuse, misuse, accident, disaster, or unauthorized modification or repair. All removal, shipping and installation costs are the Customer’s responsibility. iBEAM will return the repaired camera to the Customer by prepaid ground shipment service.

A camera’s lifecycle is defined as its serviceable life (the period during which replacement components are available) while the camera is used in conjunction with uninterrupted iBEAM Hosting services. This warranty is in lieu of all other warranties or other obligations express or implied.

The above warranty applies to new cameras sold on or after January 1, 2010.

Terms & Conditions

COPYRIGHT
Customer shall hold sole copyright to all images and time-lapse videos generated from iBEAM Hosting services (“Client Images”). Notwithstanding the foregoing, Customer grants iBEAM the perpetual, non-exclusive, royalty-free, worldwide right (i) to store copies of the Client Images; (ii) to reproduce, store, transmit and use the Client Images to provide the services to Customer hereunder; and (iii) to store and retain images for archival purposes.

iBEAM retains copyrights and ownership to its software, web sites, web applications, and other intellectual property.

ACCESS
Images, live video, and time-lapse videos captured and/or created from iBEAM Hosting services are accessed via iBEAM’s web interface (for desktop and mobile). Unless public access is specifically requested, a user account is required for access. User accounts may be requested by the Primary Contact only. Users with no access to live video and/or time-lapse footage may be requested.

STORAGE
After hosting services for a project end, iBEAM will continue to store images and time-lapse videos in perpetuity.

WEB APPLICATION END USER LICENSE AGREEMENT
iBEAM grants to Customer a limited, non-exclusive and revocable license to use the Licensed Application solely for Customer's own use. Customer shall not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, or any updates or upgrades, or any part thereof. Any attempt to do so is a violation of the rights of iBEAM. Customer shall not access or collect data using means other than that provided by iBEAM. iBEAM prohibits the use of devices or software to provide repeated automated access to the system. If Customer breaches these restrictions, Customer may be subject to prosecution and damages. iBEAM reserves all rights not expressly granted to Customer herein. By using the Licensed Application, Customer agrees to be bound and by and comply with this End User License Agreement.

SERVICE INTERRUPTIONS
Power and Internet connectivity is required for camera service. When uninterrupted service is a priority, iBEAM recommends that the Customer supply back-up power and a redundant Internet connection. The camera or network equipment may need to be rebooted at the job site to restore service.

CELLULAR DATA SERVICE
Cellular data service is subject to carrier terms and conditions.

PAYMENTS
Payment may be made by credit card, ACH, or check (upon approved credit). Invoices will be considered Past Due if not paid within 30 days of the invoice date. Service charges not exceeding one and one-half percent (1-1/2%) per month, or such lesser amounts as may be permitted under applicable law, may be imposed on past due accounts. iBEAM may without waiving any claim and without liability to the Customer, terminate services of any Customer with a past due account. Customer is responsible to pay the costs of collecting unpaid amounts, including but not limited to court costs, filing fees, and reasonable attorneys’ fees.

Customer shall pay all license fees, registration fees, assessments, imports, duties, charges, and taxes (other than taxes on iBEAM’s income) imposed by federal, state or local authorities.

BILLING
(For purchased systems.) Equipment charges will be invoiced and are due at shipment. Hosting charges begin on the day that the camera is first online and will be invoiced on a monthly basis, in advance, until the Customer notifies iBEAM of cancellation. Customer may purchase prepaid blocks of 6 or more months of hosting services at a discounted rate. Services will continue and will be invoiced on a monthly basis at the end of the prepaid period. Prepaid blocks of hosting are non-refundable, but may be applied to multiple projects. Credits for unused prepaid hosting services expire 1 year are they are issued.

(For rented systems.) The first three months' rental and hosting charges will be invoiced and are due at shipment. Additional rental and hosting charges will be invoiced monthly, in advance. Customer may purchase prepaid blocks of 6 or more months of camera rental and hosting services at a discounted rate. Additional rental and hosting services beyond the prepaid period will be invoiced on a monthly basis. If Customer does not use the entire prepaid period, the remaining prepaid amount can be applied to a subsequent project or refunded. Credits for unused prepaid rental and hosting services expire 1 year after they are issued. We require a valid credit card on file to secure against damage or loss. This card will be charged if the camera system is not returned on time, is damaged, or is missing components.

SHIPMENT
iBEAM will select the carrier and shipping method unless otherwise agreed in writing between Customer and iBEAM. Customer is responsible for paying all shipping charges, including any customs fees or duties. Equipment will be shipped to the address provided by the Customer on the New Project Information form. Re-routing of shipments may incur additional charges. Title and risk of loss passes to Customer upon shipment from iBEAM or any third-party shippers, and iBEAM is not responsible for lost or misdelivered shipments.

CANCELLATION AND TERMINATION
Production of your construction camera begins immediately after your order is received. Orders cancelled before the camera equipment has shipped are subject to a cancellation fee of 10% of equipment charges.

Orders cancelled after the camera equipment has shipped are subject to a cancellation fee of 15% of equipment charges plus shipping charges. Camera system must be returned unused, with all components and accessories, and in the original packaging within 30 days. We cannot cancel, refund, or accept returns on special order items, camera systems after 30 days, any item that has been used and/or abused, shipping charges (unless a result of our error), or hosting charges for service outages as a result of power or network issues at the Customer’s site.

Customer may terminate Hosting services and camera rental in writing at any time.

RENTAL TERMS AND CONDITIONS
The rental period starts on the day the camera system is delivered to Customer and ends when iBEAM is notified that the project is completed. Hosting charges apply from the day the camera is system is delivered to Customer and ends on the day that iBEAM is notified to turn off services.

Rented equipment shall be returned to iBEAM (postage paid and insured) within five business days of the end of the rental period in as good condition as when delivered to Customer. If the equipment is not shipped to iBEAM within five business days, a late fee equal to the equipment rental fee will be charged for the entire period until the equipment is shipped back to iBEAM. In the event the equipment or any part thereof is damaged, altered, or is not returned to iBEAM within 30 days of the end of the rental period, the Customer will be billed for the replacement value of the damaged, altered, or unreturned equipment or item as determined by iBEAM; this amount will be charged to the credit card provided.

Customer assumes all risk of loss or damage to the equipment until returned to iBEAM and shall provide special form property insurance with a replacement cost valuation provision insuring against loss or damage to the equipment throughout the rental period. Rental charges for lost, stolen, or damaged equipment will continue until iBEAM receives full replacement value or repair cost of said equipment. Rental charges will not be offset against replacement value or repair cost.

iBEAM shall retain all rights, title, and interests in and to the equipment provided to Customer. Customer shall not remove or permit removal of any serial number, model, name, or other indicia showing ownership of the equipment. All equipment is and shall at all times remain separate items of personal property, notwithstanding the attachment or fixing of them to any items of equipment or to real property or any building thereon.

USE
Customer will not, nor will permit others to use the construction camera in any way that violates any law or regulation or subjects iBEAM to liability.

LIMITATION OF LIABILITY
iBEAM SHALL IN NO EVENT HAVE ANY LIABILITY TO CUSTOMER OR ANY OTHER PERSON FOR ANY LOSS OF PROFITS, LOSS OF USE, OR INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY OR FORM OF ACTION, EVEN IF iBEAM HAS BEEN ADVISED OF THE POSSIBILITY THEREOF, ARISING OUT OF OR IN CONNECTION WITH THE SALE, DELIVERY, INSTALLATION, USE, REPAIR OR PERFORMANCE OF THE EQUIPMENT, THE SOFTWARE, THE WEB APPLICATIONS OR THE SERVICES, OR ANY FAILURE OR DELAY IN CONNECTION WITH ANY OF THE FOREGOING. THE MAXIMUM THAT iBEAM MAY BE LIABLE FOR UNDER THIS AGREEMENT SHALL BE LIMITED TO THE TOTAL CHARGES FOR THE EQUIPMENT AND SERVICES PAID TO iBEAM FOR THE 12 MONTHS AFTER CUSTOMER'S CLAIM FIRST AROSE. iBEAM expressly disclaims all implied warranties of merchantability or fitness for a particular purpose. The system is to be used only as a reference aid. The system is not a substitute for the exercise of professional judgment. iBEAM SHALL HAVE NO LIABILITY RESULTING FROM USE OF OR RELIANCE ON ANY INFORMATION, WHETHER CORRECT OR INCORRECT, OBTAINED FROM OR THROUGH THE SYSTEM.
